Terms of Service

These Terms govern your use of Saltwater (also known as Band Practice Recordings), the rehearsal and gig-management platform at bandpractice.app. By creating an account, uploading content, or otherwise using the service, you agree to these Terms.

1. Who we are

Saltwater is operated by a sole trader registered in the Czech Republic. The operator's full identifying details (legal name, registered seat, IČO) are filed with the Czech business register and available on request via [email protected]. We act as the data controller for personal data you give us; see the Privacy Policy for details.

2. What Saltwater is and isn't

Saltwater is a tool for bands to record rehearsals, plan gigs, build setlists, design stage plots, and (optionally) share music with the public. It is not a recording studio, not a label, not a booking agent, and not a payment processor for your fans — when we display third-party services (payments via Stripe, email via Postmark, hosting on Cloudflare) we tell you which one is involved.

3. Your account

You must be at least 16 to create an account. You're responsible for the security of your login (one of the reasons we use passkeys where possible). If you suspect unauthorised access, email us at the address above and we'll invalidate the session.

4. Your content

Everything you upload — recordings, setlists, stage plots, comments, photos — stays yours. You grant us a non-exclusive, worldwide licence to host, transmit, transcode, and back up that content so the service can function. We never sell your recordings, and we never use them to train AI models without separate written consent.

You're responsible for having the rights to whatever you upload. Don't upload music you don't have permission to distribute. If a copyright holder sends us a valid takedown notice, we'll act on it — see the DMCA / EU DSA section.

5. Free tier and paid tiers

The free tier is permanent. We may change paid-tier features or prices with at least 30 days' notice via email; you can cancel before the change takes effect and the new terms won't apply to you.

Public stage plots (the anonymous /stage-plot tool) and the shared-link viewer are free forever; we will not start charging existing free users for things that were free when they signed up.

Storage is "reasonable-unlimited". We don't meter your storage with a hard cap — you get reasonable, fair-use unlimited storage for your band's recordings and public songs. "Reasonable" means normal use for a real band; we reserve the right to contact you and apply reasonable limits only in cases of clearly abusive or non-genuine use (e.g. using the service as bulk file hosting unrelated to your music). We'll always give notice before restricting a genuine band's storage.

6. Public content and the audience side

Recordings are private by default. To make a song public, you must explicitly flip a switch on that specific track. We do not auto-publish anything from your rehearsal feed.

7. DMCA / EU DSA takedowns

We comply with US DMCA §512 safe harbour and the EU Digital Services Act notice-and-action mechanism. Our designated agent contact + the takedown form live at /legal/notice. Repeat infringers have their accounts terminated.

8. Termination

You can delete your account at any time from the profile settings; we'll remove your personal data within 30 days except where retention is legally required (invoices, log files for security audit). We may suspend or terminate accounts that violate these Terms or use the service for illegal activity.

9. Liability

We provide Saltwater "as is" without warranties of uninterrupted availability. To the extent permitted by law, our aggregate liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Czech or EU consumer protection law.

10. Disputes and governing law

These Terms are governed by Czech law. Disputes go before the competent Czech courts. If you're a consumer in the EU you have additional rights you can exercise via your local consumer-protection authority and the EU ODR platform.

11. Changes to these Terms

When we change the Terms substantively, we publish the new version with a new effective date and email registered users. The version that applies to you is the one you last consented to via the signup checkbox or via a re-consent prompt.
